With Love Bakery

By placing an order with With Love Bakery, you acknowledge that you have read, understood and agreed to the following Terms & Conditions. These terms apply to all cake, dessert and other product orders placed through our website, booking forms, email, social media or any other method of booking.

With Love Bakery reserves the right to update these Terms & Conditions from time to time. The terms applicable to your order will be those in place at the time your booking is confirmed.

1. ORDERS & BOOKINGS

• All custom cake and event orders must be submitted through the official With Love Bakery booking form or website.
• An order is not confirmed until With Love Bakery has accepted the booking and the required deposit has been paid.
• A deposit must be paid within 72 hours of the invoice being issued unless otherwise agreed in writing.
• Dates are not held or secured without payment.
• With Love Bakery reserves the right to decline an order where the requested date, design, flavour, size or other requirements cannot be accommodated.
• Submitting an enquiry or booking form does not guarantee availability.

2. PAYMENTS

• A non-refundable deposit is required to secure your booking.
• The remaining balance must be paid in full 7 days prior to collection or delivery, unless otherwise agreed in writing.
• Wedding cake balances must be paid 14 days prior to the wedding date unless otherwise agreed.
• If the final balance is not received by the required due date, With Love Bakery reserves the right to cancel the order and retain payments already made.
• Your order will not be released until payment has been received in full.
• Any additional items, design changes or upgrades requested after the original booking may incur additional charges and must be paid prior to the order being completed.

3. CANCELLATIONS & REFUNDS

• Deposits are strictly non-refundable as they secure your date and cover preparation, administration and the loss of potential bookings for that date.
• Cancellations made after booking may result in the partial or full loss of payments made, depending on how close the cancellation is to the collection/delivery date.
• Due to the custom nature of our products, refunds cannot be provided for change of mind.
• Refunds will not be provided where a client changes their mind about the agreed design, colours, flavours or other details after the order has been confirmed.
• Refunds will not be provided for cakes that have been consumed, partially consumed, cut or otherwise disposed of. The cake must be returned to With Love Bakery so the product can be assessed.
• Refunds will not be provided solely because an exact decoration, topper, ribbon, flower, pearl or other decorative item is unavailable. Decorations are sourced from third-party suppliers and are subject to availability.
• Every effort will be made to source suitable alternatives that complement the agreed design.

Refunds will only be considered where the final product does not reasonably meet the confirmed order specifications, such as:

• Incorrect flavour
• Incorrect size
• Incorrect theme
• A significant design element agreed upon in writing has been omitted
• A significant deviation from the confirmed design brief

Due to the handmade and artistic nature of custom cakes, minor variations in colour, piping, texture, proportions, placement and decorative details do not constitute grounds for a refund.

4. CUSTOM DESIGN & CREATIVE INTERPRETATION

• All cakes are handmade and individually designed based on the information, inspiration and requirements provided by the client.
• Inspiration photographs are used as a guide only and are not guaranteed to be replicated exactly.
• Cakes will not be exact replicas of another cake artist's work, Pinterest images, Instagram images or other reference photographs.
• Colours may vary slightly depending on lighting, photography, edible products and screen settings.
• Textures, piping, flowers, decorations and other handmade details may vary from reference images.
• Some creative freedom is required to allow With Love Bakery to create a cake that is achievable, structurally sound and visually cohesive.
• By placing an order, the client acknowledges and accepts the handmade and artistic nature of the product.

Inspiration Images

Inspiration images are intended to communicate the overall style, theme and feel of a cake rather than guarantee an exact replica.

If an inspiration image contains elements that are unavailable, unsuitable, structurally impractical or unable to be recreated using edible materials, With Love Bakery may make reasonable adjustments while maintaining the overall design direction.

5. AI-GENERATED INSPIRATION IMAGES

Where a client provides an AI-generated image as inspiration, the image will be treated as conceptual inspiration only and not as an exact representation or guarantee of the final cake.

AI-generated images may contain unrealistic, technically impossible or highly stylised elements that cannot be accurately reproduced using real cake-decorating techniques and materials.

The final cake may therefore differ in:

• Proportions
• Colours
• Textures
• Piping
• Decorations
• Structure
• Flower arrangements
• Finishing details

Minor or substantial adjustments may be necessary to create a realistic, stable and achievable cake.

Complaints or refund requests based solely on differences between an AI-generated image and the completed cake will not be accepted where the cake has been produced in accordance with the agreed design brief, consultation and/or written description.

6. DESIGN CHANGES

Once a booking has been confirmed, design changes may be limited depending on the time available.

Major Design Changes

Major changes include, but are not limited to:

• Changing the overall theme
• Changing the cake size or structure
• Changing the colour scheme
• Changing the overall design concept
• Adding significant design elements
• Changing the style of the cake

Major design changes require:

• A new booking form to be completed where required; and
• A minimum of 7 days' notice prior to collection/delivery.

Minor Design Changes

Minor changes, such as small wording updates or slight colour adjustments, require at least 3 days' notice.

Changes requested outside these timeframes may not be possible and are subject to availability.

Additional charges may apply depending on the nature of the requested change.

7. FLOWERS & DECORATIONS

• Flowers, ribbons, pearls, toppers, charms and other decorative elements are subject to availability.
• Where a specific decoration is unavailable, With Love Bakery may substitute it with a suitable alternative that complements the agreed design.
• Fresh flowers are subject to seasonal availability and may vary from inspiration photographs.
• Where fresh flowers are requested, the client acknowledges that the exact flower varieties, colours and sizes cannot always be guaranteed.
• Any decorations not specifically included in the selected cake design are considered optional add-ons and may incur additional charges.

8. ALLERGIES & DIETARY REQUIREMENTS

With Love Bakery operates in a kitchen that handles common allergens including, but not limited to:

• Dairy
• Eggs
• Gluten/wheat
• Soy
• Nuts

While every reasonable effort is made to minimise cross-contamination, we cannot guarantee that any product is completely free from traces of allergens.

Clients must notify With Love Bakery of any allergies or dietary requirements before placing an order.

With Love Bakery cannot accept responsibility for allergic reactions where an allergy or dietary requirement has not been disclosed prior to the order being prepared.

9. COLLECTION

• Cakes are available for collection at the scheduled collection time.
• Collection is by appointment only.
• Please arrive at your allocated collection time and allow sufficient time for the cake to be safely transported.
• Once the cake has been collected and leaves the With Love Bakery premises, responsibility for the cake transfers to the client.
• Care instructions will be provided and must be followed to maintain the quality and appearance of the cake.

Late Collection

Cakes are prepared specifically for the agreed collection time.

If you arrive late, this may impact our ability to accommodate your collection, particularly where another booking or appointment is scheduled.

In the event of significant lateness, With Love Bakery reserves the right to leave the cake in a designated collection area where reasonably possible.

If this is not reasonably possible, the collection may need to be cancelled, with no refund or replacement provided.

Every reasonable effort will be made to ensure you are still able to receive your order.

10. TRANSPORTING YOUR CAKE

Once a cake has been collected, With Love Bakery is no longer responsible for damage caused during transportation, handling, storage or setup.

Clients are responsible for ensuring:

• The cake is transported on a flat, stable surface.
• The vehicle is appropriately air-conditioned.
• The cake is not placed on a passenger's lap or an unstable surface.
• The cake is handled carefully.
• The cake is stored appropriately upon arrival.

Detailed cake care and transportation instructions will be provided where applicable.

11. DELIVERY

Where delivery is selected, the client must provide accurate delivery details and ensure someone is available to receive the cake.

Once the cake has been safely delivered to the agreed location and accepted by the recipient, responsibility transfers to the client or recipient.

With Love Bakery is not responsible for damage caused after delivery due to moving, transporting, storing, displaying or handling the cake.

Delivery times may be affected by traffic, weather, road conditions or circumstances outside of our reasonable control.

12. COMPLAINTS & ISSUES WITH YOUR ORDER

We want every client to be happy with their cake. If you believe there is an issue with your order, please contact With Love Bakery within 24 hours of collection or delivery.

Where there is an issue, the cake must be retained and, where requested, returned to With Love Bakery for assessment.

Refunds will not be issued for cakes that have been consumed, discarded or otherwise made unavailable for assessment.

Where appropriate, With Love Bakery may offer a resolution such as:

• A partial refund
• Store credit
• A replacement product
• Another reasonable resolution

Any resolution will be determined at the discretion of With Love Bakery based on the nature of the issue.

Refunds will not be provided for:

• Change of mind
• Differences between the final cake and an inspiration image
• Minor variations resulting from the handmade nature of the product
• Late design changes
• Decorations that were unavailable from suppliers
• Dissatisfaction where the cake reasonably aligns with the agreed design brief
• Personal preference where the confirmed specifications have been met

13. PHOTOGRAPHY & SOCIAL MEDIA

With Love Bakery reserves the right to photograph completed cakes and use these images for marketing, promotional material, social media, website content and portfolio purposes.

If you do not wish for your cake to be photographed or shared publicly, please advise With Love Bakery in writing prior to collection or delivery.

14. PRODUCT AVAILABILITY & PRICING

• Product availability, pricing, flavours, decorations and design options are subject to change.
• Prices displayed on the website apply at the time of purchase and may be updated without notice.
• With Love Bakery reserves the right to discontinue products or make changes to products, flavours or design options where necessary.
• Where an order has already been confirmed and paid, the agreed price will remain applicable unless the client requests additional products or changes.

15. WEBSITE & ONLINE ORDERS

Every effort is made to ensure that information, photographs, product descriptions, pricing and availability displayed on the With Love Bakery website are accurate.

However, due to the handmade nature of our products, the final cake may vary slightly from website photographs.

Images are intended to demonstrate the style and quality of our work and should not be interpreted as a guarantee that your cake will look identical.

16. UNFORESEEN CIRCUMSTANCES

While every effort is made to fulfil all confirmed orders, With Love Bakery cannot be held responsible for circumstances outside of our reasonable control, including but not limited to serious illness, accidents, natural disasters, extreme weather, power outages, supplier shortages or other unforeseen circumstances.

Where possible, we will work with the client to provide a suitable alternative or resolution.

17. FINAL PRODUCT

Every With Love Bakery cake is handmade and individually finished.

Because of this, slight variations may occur between the final product and reference images, including differences in:

• Colour
• Piping
• Texture
• Shape
• Size of decorative elements
• Flower varieties
• Placement of decorations
• Overall finishing

These variations are part of the handmade nature of our products and do not constitute a defect.

By placing an order with With Love Bakery, you acknowledge and agree to the artistic and handmade nature of your cake.

18. ACCEPTANCE OF TERMS

By submitting a booking form, placing an order, making payment or purchasing a product through the With Love Bakery website, you acknowledge that you have read, understood and agreed to these Terms & Conditions.
